Welcome to myEventic.com ("myEventic", "we", "us", or "our"). These Terms & Conditions ("Terms") govern your access to and use of our website, mobile apps, and related services for discovering, purchasing, receiving, transferring, and managing tickets for events (collectively, the "Services"). By using the Services, you agree to these Terms.
1. Definitions
- "Organizer" means the event promoter, venue, producer, or other party responsible for the event.
- "Ticket" means any right of admission (including e-tickets, QR codes, wristbands, badges, and passes) issued via the Services.
- "Consumer" means an individual acting for purposes outside their trade, business, craft, or profession.
2. Role of myEventic
Unless expressly stated otherwise, myEventic provides a ticketing platform and acts as a disclosed agent for the Organizer. The contract for the event (including admission, production, and event rules) is between you and the Organizer. We may collect payment as agent. We are not responsible for the event experience, changes to line-ups, seating, or event policies set by the Organizer or venue.
3. Account Registration
- You must be at least 18 years old and provide accurate, complete information.
- You are responsible for safeguarding your credentials and all activities under your account.
4. Purchasing Tickets
- Placing an order constitutes an offer to buy. Orders are accepted when we issue an order confirmation and deliver Tickets (or a confirmation of availability) to your account or email.
- All prices are shown inclusive or exclusive of taxes and fees as indicated at checkout. Booking, service, delivery, and payment processing fees may apply.
- We may set quantity limits per person, per payment method, or per household, and may cancel orders that breach limits or suspected abusive buying (including use of bots or multiple identities).
5. Delivery of Tickets
- Tickets are typically delivered as e-tickets or QR codes to your account and/or email. Keep your Tickets safe. Each Ticket generally admits one person per scan; duplicates may be invalidated.
- If you do not receive your Ticket within the time indicated, contact us promptly with your order reference.
6. No Right of Withdrawal for Dated Leisure Services
Under applicable EU consumer law, the statutory 14-day right of withdrawal does not apply to services related to leisure activities when the contract provides for a specific date or period of performance (such as dated event Tickets). Therefore, once purchased, Tickets are generally non-refundable and non-cancellable, except as set out in these Terms or required by law or by an Organizer’s posted policy.
7. Refunds, Cancellations, Postponements & Rescheduling
- Cancellation: If an event is cancelled and not rescheduled, you will usually be entitled to a refund of the price paid for the Ticket (excluding add-on services already provided), subject to the Organizer’s policy and applicable law.
- Postponement/Reschedule: If an event is postponed or rescheduled, your Ticket will typically remain valid for the new date. Where permitted by the Organizer’s policy or by law, you may request a refund within the specified window.
- Partial Performance/Material Changes: Material changes (for example, significant changes to date, venue, or headliner) are handled per the Organizer’s policy and applicable law. Administrative fees may be non-refundable unless required otherwise.
- Force Majeure: Neither myEventic nor the Organizer is liable for non-performance caused by events beyond reasonable control (e.g., extreme weather, natural disasters, public health emergencies, strikes, government actions, or power/telecom failures). Remedies, if any, are determined by the Organizer’s policy and applicable law.
- How Refunds Are Paid: Refunds, if approved, are issued to the original purchaser via the original payment method where feasible. Processing times may vary by payment provider.
8. Transfers, Name Changes & Resale
- Ticket transferability depends on the Organizer’s rules. Some Tickets may be non-transferable or limited to an official exchange/resale channel.
- Unauthorized resale at a price above face value, or on unapproved platforms, may result in cancellation without refund and denial of entry. We may void Tickets that breach limits or resale rules.
9. Admission & Venue Rules
- Admission is controlled by the Organizer/venue and is subject to their policies (e.g., security checks, prohibited items, age restrictions, dress codes, late entry, re-entry, and health/safety measures). Breach of rules may lead to refusal or removal without refund.
- Arrive with valid identification if required. Counterfeit, altered, or previously scanned Tickets are invalid.
10. Pricing, Fees & Taxes
- Total payable amounts, including fees and taxes, are disclosed at checkout. Dynamic pricing or tiered pricing may be used by Organizers for certain events.
- Where required, VAT or other taxes are charged in accordance with applicable tax rules.
11. Fraud, Abuse & Chargebacks
- We may cancel orders or Tickets and block accounts for suspected fraud, misuse, or policy breaches (including bot purchases or circumventing limits).
- Unjustified payment disputes/chargebacks may result in account restriction and debt collection for sums due, subject to applicable law.
12. Errors
If a manifest pricing or availability error is identified, we may cancel affected orders and issue a refund. Obvious mistakes do not bind us or the Organizer.
13. Liability
- Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot be limited under applicable law.
- To the fullest extent permitted by law, myEventic is not responsible for: (a) event fulfillment or quality; (b) indirect or consequential losses; (c) personal property at the venue; or (d) travel and accommodation costs.
- Subject to the foregoing, our aggregate liability relating to a Ticket purchase is limited to the total amount paid for that Ticket, excluding third-party costs not paid to us.
14. Data Protection
Your personal data is processed in accordance with our Privacy Policy. We may share necessary data with Organizers and venues to deliver the Services, verify identity, prevent fraud, and manage entry.
15. Intellectual Property
All content on the Services (including trademarks, logos, and software) is protected by intellectual property rights. You may not use, copy, or reproduce content without permission.
16. Complaints & Customer Support
If you have an issue with your order, please contact us promptly with your order reference and relevant details. We aim to respond within a reasonable timeframe. For event-specific issues (like set times or line-up), contact the Organizer or venue.
17. Governing Law & Jurisdiction
These Terms are governed by the laws of Romania, without prejudice to mandatory consumer protections under the law of your habitual residence within the EU/EEA. Courts at your place of residence may have jurisdiction where required by consumer law.
18. Changes to These Terms
We may update these Terms from time to time. Where changes are material, we will provide reasonable notice (e.g., by email or notice on our website). Continued use of the Services after changes take effect constitutes acceptance.
